Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or playing Momentum: Overdrive (the "Application"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not accept these Terms in full, you must refrain from installing or accessing the Application and delete all copies installed on your Apple hardware immediately.

2. Limited License Grant

Subject to your compliance with these Terms, Momentum Overdrive Interactive grants you a personal, non-exclusive, non-transferable, revocable, and royalty-free license to download and operate one copy of the Application on compatible iOS devices that you own or control, solely for your personal, non-commercial entertainment purposes.

• No Commercial Redistribution: You may not sell, lease, sublicense, distribute, host, or commercially exploit any portion of the Application.
• Platform Terms: This license is also subject to the usage rules set forth in Apple Media Services Terms and Conditions and the App Store Standard EULA.

3. Intellectual Property Rights

All rights, titles, and interests in and to Momentum: Overdrive—including but not limited to custom kinematic trajectory algorithms, momentum overdrive progression logic, procedural puzzle generation routines, holographic user interface elements, visual shaders, iconography, sound effects, and source code—are the exclusive intellectual property of Momentum Overdrive Interactive and its licensors.

4. User Conduct & Integrity

You agree that you will not participate in any unauthorized actions that disrupt or compromise the game's balance or security:

• Decompile, disassemble, reverse engineer, or attempt to derive the source code or physics algorithms of the Application.
• Use unauthorized third-party software, memory editors, cheats, macros, or automated bots to alter game calculations or artificially inflate high scores.
• Bypass, modify, disable, or circumvent any security safeguards, rate-limiting systems, or integrity verification hooks embedded in the Application.
• Interfere with or attempt to compromise server infrastructure, crash telemetry pipelines, or dispute channels connected with the game.

6. Game Data & Virtual Saves

Player campaign achievements, high-score records, unlocked kinetic cores, and preference configurations are primarily serialized in your local device sandbox storage (`NSUserDefaults` and application support files).

If you uninstall the Application or perform a complete wipe of your device without preserving a system-level iCloud backup, your local progress and unlocked items may be permanently reset. Momentum Overdrive Interactive assumes no liability for the loss of locally stored game records resulting from device corruption or manual data deletion.

7. Disclaimer of Warranties

THE APPLICATION IS DELIVERED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE JURISDICTIONS, MOMENTUM OVERDRIVE INTERACTIVE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM PROGRAM ERRORS, AND NON-INFRINGEMENT.

We do not warrant that operation of the Application will be continuous, uninterrupted, completely error-free, or compatible with all versions of iOS or future hardware iterations.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOMENTUM OVERDRIVE INTERACTIVE, ITS AFFILIATES, DIRECTORS, OR DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF SAVED DATA, DEVICE MALFUNCTION, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE INSTALLATION OR USE OF THE APPLICATION.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE APPLICATION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR PURCHASING OR ACCESSING THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
